Between Law and Politics: The Constitution and Regulation of the European Single Market
Although little discussed, the Single Market is at the heart of European integration, the most deeply integrated of all policy-areas. This advanced seminar explains how the Single Market works in theory and practice. Through different examples, ranging from goods to services and competition policy, it examines when and why the Single Market affects seemingly unrelated policies on the EU and national level, creating tensions that may push toward further integration. The conceptual focus is on the interplay of law and politics in creating and regulating the Single Market. This includes central institutions and actors such as the European Court of Justice and the EU’s legal system as well as the European Commission as guardian of the Treaty and highest competition authority.
Through this advanced class, students will
- know the principles on which the Single Market is built, and be able to identify its major successes and challenges.
- understand how the Single Market affects various policy areas on the national and EU level
- be able to distinguish between legal and political integration
- apply these concepts to compare different policy-areas related to the single market
- be able to research as well as discuss and critically evaluate selected political science literature through different media (writing, graphics, presenting).
• Guided Reading with Tasks: Students read selected political science literature from the syllabus. Before each session, they are required to submit short task and/or answers to a text-related quiz • Classroom discussion: The classroom discussions are structured by the weekly tasks and alternate between small groups and the plenary, as appropriate given learning outcomes and progress.
• Group Project: Students will prepare a poster that discusses an aspect of the Single Market, preferably applying or illustrating at least one of the theoretical concepts introduced in the seminar. The poster must take account of relevant academic literature. It will be presented in class during a short (5–10 minutes) informal presentation. Students should also provide commentary on other posters.
• Written assignment: Students will write a case-study (3500–4000 words excluding references) on an issue related to the single market (e.g. the liberalization or re-regulation of a particular sector), applying or illustrating the theoretical concepts discussed in the seminar. The essay may extend the poster with additional material and it should engage with the feedback received from the class and the lecturer.
